Draft — not yet in force

This page is a working draft. It has not been reviewed by counsel, the highlighted values below are unfilled placeholders, and nothing here is binding on you or on us yet. Using ShowPlotter today does not constitute agreement to these terms. Questions in the meantime: support@showplotter.com.

Terms of Use

Last updated TODO(owner): effective date

Planning aid, not an approval

ShowPlotter helps you draw and document a site plan. It does not approve, certify, or authorize anything. Geofences, separation distances, NFPA 1123 fallout radii, drone counts, and every other figure the app draws or computes are planning aids based on the inputs you supply — they are not a regulatory determination and they are not a substitute for your own judgement.

You, the operator, remain fully responsible for the safety and the legality of your operation: FAA regulations and any required authorizations or waivers, NFPA 1123 and other applicable fire codes, the requirements of your local authority having jurisdiction (AHJ), landowner and venue permissions, insurance, and your own crew's competence. Verify every distance, boundary, and clearance against the governing rules and the real site before you fly or fire. If the plan and the rules disagree, the rules win.

1. Who these terms are between

These Terms of Use ("Terms") govern your access to and use of showplotter.com and the ShowPlotter application (the "Service"), operated by TODO(owner): legal entity name, e.g. Robota LLC ("we", "us", "our"). By using the Service you agree to these Terms. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 18 years old, or have the legal capacity to enter into a binding contract under the law that applies to you. If you use the Service on behalf of a company, you confirm that you are authorized to accept these Terms for it.

3. Your account

You can plan as a guest without an account; that work stays in your own browser. To save, share, or export from the cloud you create an account through our sign-in provider. Keep your credentials to yourself — you are responsible for what happens under your account. We may suspend or close accounts that abuse the Service, and you can email us to close yours at any time (see the Privacy Policy).

4. Your content stays yours

The plans, maps, shapes, production details, logos, and other material you put into the Service ("Your Content") remain yours. You grant us only the permission we need to run the Service: to store Your Content, display it back to you, render it into exports, and serve it to the people you give a share link to. We do not sell it and we do not use it to train anything.

You confirm you have the right to upload what you upload — including any client logo or branding you add to an export.

5. Share links

A share link is a capability: anyone who has it can view that plan, read-only, without signing in. That is the feature working as intended. Treat share links as you would the plan itself and only send them to people who should see it.

6. Acceptable use

Do not use the Service to:

  • plan or support any operation that is illegal where it takes place;
  • misrepresent a plan as an approval, permit, certification, or regulatory clearance issued by us or by any authority;
  • attempt to break, overload, scrape, reverse-engineer, or gain unauthorized access to the Service or to other users' plans;
  • upload content that infringes someone else's rights or that is unlawful.

7. Our intellectual property

The Service itself — the software, the interface, the ShowPlotter name and logo — belongs to us or our licensors. These Terms give you the right to use the Service, not to copy or resell it. Map imagery and address data are provided by third parties under their own terms.

8. Availability and changes

We do everything we reasonably can to keep the Service running and your plans intact, but the Service is provided "as is" and "as available", without warranty of any kind, to the maximum extent the law allows. Features may change, and the Service may be interrupted for maintenance or for reasons outside our control. Keep your own copies of anything you cannot afford to lose — every plan can be exported as a PDF and as JSON.

9. Limitation of liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, nor for lost profits, lost data, or losses arising from a show that was delayed, cancelled, denied a permit, or conducted unsafely. Our total liability for any claim relating to the Service is limited to the amount you paid us for the Service in the twelve months before the claim.

Nothing in these Terms limits liability that cannot be limited by law.

10. Indemnity

You agree to hold us harmless from claims arising out of your use of the Service, the operations you plan with it, and content you upload — except to the extent the claim is caused by us.

11. Governing law

These Terms are governed by the laws of TODO(owner): governing law state / county, and you agree to the exclusive jurisdiction of the courts located there for any dispute arising from them.

12. Changes to these Terms

We may update these Terms by posting a new version on this page; the date above moves when we do. Continuing to use the Service after a change means you accept it.
